These Terms of Service (“Terms”) are an agreement between you and TransfersCO (Pty) Ltd(“TransfersCO”, “we”, “us”). They govern your access to and use of our website, apps and booking services across 89 countries. By making a booking or using our services, you agree to these Terms. If you do not agree, please do not use the service. Your privacy is covered separately by our Privacy & Cookie Policy.
About these terms
We may provide additional terms for specific products (for example tours, coach charter, corporate accounts or partner portals); where those apply, they form part of this agreement. If there is a conflict, the product-specific terms prevail for that product. Nothing in these Terms limits any rights you have under applicable consumer-protection law (including South Africa’s Consumer Protection Act) that cannot be excluded.
Note for publication: before these Terms go live, add TransfersCO’s registered company number and physical office address here, and have them reviewed by a qualified attorney for your operating jurisdictions.
What TransfersCO is
TransfersCO is a booking platform that connects travellers with ground-transport and tour services provided by vetted drivers, fleet partners, suppliers and operators. Depending on the service and route, we act either as a booking intermediary arranging the service on your behalf, or as the contracting party. In all cases the transport or tour itself is performed by a driver, operator or supplier.
Accounts & eligibility
You must be at least 18 years old and able to enter into a binding contract. You may book without an account, but if you create one you are responsible for keeping your credentials secure and for activity under your account. Provide accurate, current information — bookings rely on the contact and trip details you give us.
Bookings, quotes & prices
- A quote is an offer valid for the period stated (or until it expires). A booking is confirmed once we accept it and, where payment is required upfront, once payment is received.
- Many of our routes are fixed-price: the price shown at booking is the price for the trip as described. Prices are inclusive of applicable taxes unless stated otherwise.
- Prices can vary with route, distance, vehicle class, time of day, waiting time, additional stops, extras, and the number of passengers or luggage. Materially changing the trip after booking may change the price.
- We take reasonable care to price and describe services accurately. In the rare event of an obvious error, we may correct it or cancel the affected booking and refund you.
Payment, fees & currency
Payments are processed by regulated third-party payment providers. By paying, you authorise the charge for the total shown. We support multiple currencies; the currency and amount charged are those shown at checkout. Where a booking is made on account (for corporate or partner arrangements) or paid from a prepaid partner wallet, the applicable account terms govern billing and settlement.
Changes, cancellations & refunds
- You can request a change or cancellation by contacting us; whether a change is possible depends on timing, the operator and the service booked.
- Refunds and any cancellation fees depend on how close to the pickup time you cancel and the terms of the specific service. Where a service has its own cancellation policy, that policy applies and is shown before you book.
- No-shows and late cancellations (for example failing to appear at the pickup point within a reasonable waiting time, or cancelling too close to pickup) may be non-refundable, because the driver or operator has already been committed.
- We may cancel a booking if it cannot be fulfilled, if payment fails or is reversed, or in cases of suspected fraud or misuse — with a refund where you have paid and the service was not provided.
Your responsibilities
- Give accurate pickup, drop-off, timing, flight and contact details, and be ready at the agreed pickup point and time.
- Ensure the passenger count, luggage and any special requirements match your booking, and comply with the vehicle’s capacity and safety rules (including seatbelt and child-seat requirements).
- Behave lawfully and respectfully toward drivers, operators and other passengers. Do not transport illegal, dangerous or prohibited items.
- You are responsible for any damage you or your party cause beyond fair wear and tear.
Drivers, partners & suppliers
Transport and tours are performed by independent drivers, fleet partners, operators and suppliers, not by TransfersCO employees. They are responsible for holding the licences, permits, insurance and roadworthy vehicles required to provide the service. We vet partners and set service standards, but we do not control every aspect of an individual trip. Partner, fleet, provider, agent and corporate accounts are additionally governed by their portal terms.
Liability
We provide the platform and arrange services with reasonable skill and care. To the fullest extent permitted by law, we are not liable for indirect or consequential loss, or for loss caused by events beyond our reasonable control (including traffic, weather, flight delays, road closures, or acts of third parties). Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law — including for death or personal injury caused by negligence, for fraud, or under mandatory consumer-protection rights. Where we are liable, our liability is limited to the amount you paid for the affected booking, except where the law provides otherwise.
Complaints & disputes
If something goes wrong, contact us as soon as possible so we can help — most issues are resolved quickly. Email support@transfersco.africa with your booking reference and the details. We aim to acknowledge complaints promptly and resolve them fairly.
Intellectual property
The TransfersCO name, logo, website, apps and content are owned by us or our licensors and are protected by intellectual-property law. You may use the service for your own bookings; you may not copy, scrape, resell or misuse the platform or our content without our permission.
Governing law
These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction, without affecting any mandatory consumer rights available to you in your country of residence.
Changes to these terms
We may update these Terms from time to time. When we make material changes we will update the “Last updated” date above. The Terms in force at the time you make a booking govern that booking.
